Policy coverage
Scope of This Shipping Policy
This Shipping Policy applies to shipping containers and related products
purchased directly from Miami Containers LLC through our website, by
email, by telephone, through an invoice, or through another authorized
ordering method.
It applies to new, one-trip, used, cargo-worthy, wind and watertight,
High Cube, refrigerated, open-side, double-door, modified, and specialty
shipping containers unless a separate written delivery agreement states
otherwise.
Written order terms
The delivery details shown on an accepted quotation, invoice, purchase
order, or written order confirmation form part of this Policy. Where a
signed written agreement contains different shipping terms, that written
agreement will control to the extent of the difference.

Delivery schedule
Maximum 5–7 Business Day Delivery
Standard container delivery is completed within a maximum of
5–7 business days after all order requirements have
been completed.
The delivery period begins on the first business day after:

The customer has accepted the final quotation or invoice.
✓
Full payment has been received and cleared.
✓
The selected container has been confirmed as available.
✓
The complete delivery address and ZIP code have been provided.
✓
Site-access and placement information has been confirmed.
✓
Any required delivery photographs or measurements have been received.
Business-day definition
Business days are Monday through Friday and exclude Saturdays,
Sundays, federal holidays, and days on which banking, transportation,
government, or delivery operations are officially closed.

Delivery cost
$650 Flat-Rate Shipping
Standard Shipping Charge
$650
Flat-rate delivery per eligible order
Miami Containers LLC charges a standard flat-rate shipping fee of
$650 per eligible order. The shipping fee will be
displayed on the quotation, invoice, checkout page, or written order
confirmation before payment is completed.
The $650 flat rate covers standard transportation and normal unloading
at an accessible delivery site. It does not automatically include
specialized modification work, storage after a failed delivery, permits,
site preparation, foundations, utility disconnection, road closures,
police escorts, or third-party construction services.

Before dispatch
Order Processing and Confirmation
An order is not scheduled for delivery until Miami Containers LLC has
received cleared payment, confirmed product availability, verified the
delivery address, and approved the supplied access information.
After the order has been approved, the customer may receive a confirmation
containing:
- Container size, type, condition, and quantity.
- Delivery address and customer contact information.
- The $650 flat-rate shipping charge.
- Estimated delivery date or delivery window.
- Placement and cargo-door orientation instructions.
- Any approved modifications or special order details.
Customers must review the confirmation and promptly report incorrect
information. Miami Containers LLC is not responsible for delays caused
by incomplete or inaccurate details supplied by the customer.

Delivery appointment
Scheduling and Customer Availability
Delivery dates and time windows may be communicated by email, telephone,
text message, or through the transportation provider. Unless expressly
confirmed in writing, a delivery time is an estimated arrival window
rather than a guaranteed appointment time.
The customer or an authorized adult representative must be available
at the delivery location to:
- Confirm the final placement location.
- Direct the driver where it is safe to unload.
- Inspect the container after unloading.
- Sign any delivery documentation when requested.
- Ensure children, animals, vehicles, and unauthorized persons remain clear.
If the customer cannot attend, written placement instructions must be
provided before the delivery date. Delivery without the customer present
remains subject to safe access and the driver’s reasonable judgment.

Customer responsibility
Site Access and Preparation
The customer is responsible for ensuring the delivery location is safe,
accessible, stable, and suitable for the delivery vehicle, unloading
method, and shipping container.

Road Access
Roads, driveways, gates, and entrances must be wide and strong enough
for a large commercial delivery vehicle.

Turning Space
The driver must have adequate room to enter, turn, reverse, position,
unload, and safely exit the property.

Overhead Clearance
The route and unloading area must be clear of power lines, branches,
roofs, signs, bridges, cables, and other overhead obstacles.

Stable Ground
The ground must be level, firm, and capable of supporting the delivery
vehicle and the loaded or unloaded container.

Prepared Foundation
Any concrete pads, blocks, railroad ties, gravel base, piers, or
foundation must be completed before the driver arrives.

Clear Placement Area
Vehicles, debris, construction materials, fences, equipment, and
other obstructions must be removed before delivery.
Driver safety authority
The driver may refuse to enter, unload, or continue at a location that
appears unsafe, inaccessible, unstable, unlawful, or likely to damage
the vehicle, property, container, surrounding structures, or persons.

Placement instructions
Container Unloading and Final Placement
Containers are unloaded using the method arranged for the order, which
may include a tilt-bed, roll-off trailer, crane, side loader, or another
suitable delivery vehicle.
The customer must identify the preferred placement position and cargo-door
direction before unloading begins. Once the container has been unloaded
and the delivery vehicle has departed, the flat-rate shipping charge does
not include moving or repositioning the container.
Exact placement is not guaranteed when site conditions, equipment
limitations, obstacles, safety requirements, ground conditions, or
applicable laws prevent the driver from placing the container in the
customer’s preferred position.

Upon arrival
Inspection at Delivery
Customers should inspect the container as soon as reasonably possible
after delivery and before altering, loading, painting, repairing, or
modifying it.
The inspection should include:

Confirming the correct container size and type.
✓
Checking the doors, handles, locking bars, and seals.
✓
Reviewing the roof, walls, frame, and flooring.
✓
Confirming any agreed modifications are present.
✓
Photographing visible transport damage or material concerns.
✓
Recording concerns on the delivery document when possible.
Used containers may have dents, scratches, paint variations, previous
labels, repairs, patches, surface corrosion, and other cosmetic signs
of service. These characteristics are not automatically considered
shipping damage or defects.
Reporting delivery concerns
Material delivery damage, an incorrect container, or a substantial
difference from the written order should be reported promptly to
sales@miami-containers.com
with photographs, the order number, and a description of the concern.

Unexpected circumstances
Delivery Delays
Miami Containers LLC aims to complete standard delivery within the stated
maximum of 5–7 business days. If we become unable to ship within the
promised period, we will contact the customer using the available contact
information.
Where required, the customer will be offered the opportunity to:

Accept a Revised Delivery Date
The customer may approve a reasonable revised shipping or delivery
timeframe.

Cancel the Unshipped Order
The customer may cancel the affected unshipped order and receive
the applicable refund.
Possible causes of delivery disruption may include severe weather,
hurricanes, flooding, road closures, transportation breakdowns, carrier
availability, government action, safety restrictions, emergencies, or
other circumstances outside reasonable operational control.

Unsuccessful delivery
Failed, Refused, or Missed Delivery
A delivery may be treated as unsuccessful when:
- The address provided is incorrect or incomplete.
- The customer or authorized representative is unavailable.
- Site access is narrower, lower, weaker, or more restricted than disclosed.
- The ground is unsafe, unstable, flooded, soft, or obstructed.
- The requested placement cannot be completed safely.
- The customer refuses delivery without a legally valid reason.
- A permit, authorization, gate code, or access approval is missing.
When an unsuccessful delivery results from inaccurate information,
unsuitable access, customer unavailability, or a site condition outside
our responsibility, the original shipping charge may be nonrefundable.
Any redelivery, storage, waiting time, return transportation, or specialized
equipment must be authorized and paid before another delivery attempt.

Order changes
Address and Delivery Changes
Requests to change the delivery address, container type, container size,
delivery date, unloading method, or placement instructions must be sent
before the order is dispatched.
A requested change is not effective until confirmed in writing by Miami
Containers LLC. Changes requested after dispatch may not be possible and
may require cancellation, rescheduling, or additional transportation costs.

Legal compliance
Permits, Zoning, and Property Approval
The customer is responsible for determining whether local zoning approval,
building permits, homeowners’ association approval, landlord permission,
environmental approval, or other authorization is required before a
container is delivered or installed.
Miami Containers LLC does not guarantee that a shipping container may
legally be placed or used at a particular property. Delivery does not
constitute confirmation that the customer has obtained the required
approvals.

Responsibility for the goods
Title and Risk of Loss
Unless a written sales agreement states otherwise, title and risk of loss
will transfer in accordance with the applicable delivery terms, the type
of shipping contract, and Florida law.
For destination deliveries arranged by Miami Containers LLC, risk of loss
generally remains with the seller until the container is tendered at the
agreed destination in a manner that enables the customer to take delivery,
subject to applicable law and any written contract terms.
Risk of loss does not excuse either party from responsibility for its own
breach, negligence, intentional misconduct, or failure to comply with the
written order requirements.

Events outside control
Force Majeure
Miami Containers LLC will not be liable for a delivery delay or failure
caused by circumstances beyond its reasonable control, including severe
weather, hurricanes, flooding, fire, natural disasters, labor disruption,
carrier interruption, road closure, governmental action, civil emergency,
war, terrorism, epidemic, utility failure, equipment breakdown, or similar
events.
This section does not remove any cancellation, refund, notification, or
other nonwaivable right provided by applicable law.

Applicable law
Governing Law and Jurisdiction
This Shipping Policy is governed by and interpreted according to the
laws of the State of Florida and applicable United States federal law,
without regard to conflict-of-law principles.
Any dispute relating to this Shipping Policy, an order, or a delivery
shall be handled in accordance with the dispute-resolution and governing-law
provisions contained in the applicable Terms and Conditions or written
sales agreement.
Nothing in this Policy limits a consumer right or remedy that cannot
lawfully be waived.

Policy updates
Changes to This Shipping Policy
Miami Containers LLC may update this Shipping Policy to reflect changes
in delivery operations, carrier requirements, business practices, costs,
service areas, technology, or applicable laws.
Changes will apply prospectively from the effective date displayed on
the updated Policy. Shipping terms confirmed for an existing paid order
will not be changed retroactively unless agreed in writing or required
by law.
